This petition, purportedly in public interest, has been filed by the petitioner seeking a direction to the Collector to take possession of the land recorded as urban ceiling land situated at Village-Viharman Nagla, Tehsil and District-Bareilly from the land grabber, respondent Nos. 6 to 10 and declare them as land mafia. 2. On 02.07.2025, oral submission was made by counsel for the respondent-Development Authority, based on instructions, that the land in question, which is recorded as urban ceiling in the revenue record, is in possession of the Development Authority. 3. Based on the said submission, counsel was directed to file personal affidavit of the Vice-Chairman of the Development Authority indicating the status of possession of the land in question. 4. Personal affidavit of the Vice-Chairman, sworn on 29.07.2025, has been filed, wherein in para 7, it has been indicated that the subject lands are, as on date, in actual physical possession of the Development Authority, Bareilly surrounded by wall and certain pictures have been produced for the perusal of the Court. 5. In view of the personal affidavit filed by the Vice-Chairman, no case Versus Counsel for Petitioner(s) : Kamla Prasad Tiwari, Saurabh Kumar Tiwari Counsel for Respondent(s) : C.S.C., Abhimanyu Singh for Dharmendra Singh Chauhan, Satish Chandra Dubey Ashwani Kumar .....Petitioner(s) State of U.P. and 9 others .....Respondent(s) for entertaining the present PIL is made out, the same is, therefore dismissed.
