JUDGMENT The complainant in Calendar Case No. 167 of 2002 on the file of the learned II Additional Judicial Magistrate of First Class, Tanuku, preferred the present Criminal Appeal, challenging the Judgment dated 22.10.2007, whereunder and whereby the learned II Additional Judicial Magistrate of First Class, tanuku acquitted the accused of the offence punishable under Section 138 of the Negotiable Instruments Act, 1881, in terms of Section 255 (1) of the Code of Criminal Procedure, 1973 (for brevity ‘CrPC’). While the matter is being taken up by this Court 16.04.2025, there was no representation on behalf of the appellant/ complainant. This Court also observed that there representation on behalf of the appellant on the earlier adjournment too. Therefore, this Court, on 16.04.2025, directed the Registry to issue bailable warrant against the appellant/complainant and post the matter after Summer Vacation, 2025.
