HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 33527 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J.
HON'BLE SWARUPAMA CHATURVEDI, J.
1. Heard Sri Vinod Kumar Tiwari, learned counsel appearing for the petitioner and Sri Surendra Nath Chauhan, learned panel counsel for the respondents.
2. In this petition, petitioner is aggrieved by his status being shown in the official portal of respondent no. 2 qua "police verification not clear". In the circumstances, it is claimed that even though petitioner is in possession of passport which is valid upto 20.2.2033 he will not be able to move out of India as he would be refused visa on account of pending police verification
3. On a pointed query being made, Mr. Surendra Nath Chauhan submits that there is a criminal case pending against the petitioner and unless and until, petitioner obtains a proper order from a proper law court permitting him or showing no objection to visit outside India, such police verification report would continue to remain pending.
4. In the circumstances, we dispose of this petition with following directions, taking note of the law laid down by the Division Bench of this Court in the case of Pawan Kumar Rajbhar vs. Union of India & 2 Others (Neutral Citation No. 2024:AHC:9963-DB):- (a) Petitioner in the first instance shall move an application before the criminal law court seeking permission/No Objection/ Sanction to visit outside India within four weeks from today. Versus Counsel for Petitioner(s) : Vinod Kumar Tiwari Counsel for Respondent(s) : Surendra Nath Chauhan Atiqur Rahman .....Petitioner(s) Union Of India And Another .....Respondent(s)
(b) In the event any such application is moved by the petitioner the concerned criminal law court shall dispose of the same within a maximum period of four weeks. (c) soon after the orders passed by the criminal law court upon the application of the petitioner, petitioner shall place the same before the respondent no. 2, who shall then be passing the appropriate order clearing the police verification within the next four weeks' time.
