This is the second bail application of the applicant for grant of bail in Case Crime No. 539 of 2023, under Section 376 IPC, Police Station Rasoolpur, District Firozabad. His first bail application has been rejected by order dated 02.05.2024 passed in Criminal Misc. Bail Application No. 14888 of 2024. Learned counsel for the applicant submits that the prosecution witnesses have stated before the trial court that they have seen the victim for the first time, therefore, their statements cannot be relied upon. He has further emphasized upon the date of petitioner's arrest i.e. 15.09.2023 and requested that considering the period of detention, the petitioner may be released on bail. On the other hand, learned counsel appearing for the State submits that seeing the seriousness of the offence, where a 50 years old mentally retarded lady has been exploited by the applicant, which is also proved from the statements as recorded under Section 161 and 164 Cr.P.C., the applicant is not entitled for bail. The fact that the persons, namely, Neeraj, Rakesh and Ravi have seen the victim for the first time, is quite evident as while the incident took place they were passing by and they took the lady along with the victim to the police station when the first information report was lodged.
