Heard learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for following relief as substantial relief: "i) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 4 to release the contractual dues of Rs. 3,99,947.60 of the petitioner's firm along with interest 9% per annum from the date of 07.06.2013 till the actual date of payment which was due in respect of Contract Bond No. C.B-05/EE.2013-14 dated 08.05.2013, within stipulated period of time as may be determined by this Hon'ble Court." It is submitted on behalf of the petitioner that soon after completion of work,petitioner submitted the bill on 07.06.2013 for payment of dues against the work completed by him pursuant to the work order, but no payment was made and accordingly, he made reminder letters on 14.09.2015 and 15.11.2015. According to the petitioner, the Executive Engineer of National Highway Division of Public Works Department, Etawah wrote a letter on 10.04.2015 to Superintending Engineer for releasing the fund referring to various previous letters but nothing further progressed in the matter. Having perused the pleadings raised in the petition and also the applications made by the petitioner to the authorities and the letter written by the Executive Engineer on 10.04.2015 to Superintending Engineer and we find that petitioner has approached this Court after lapse of 10 years. Nothing has been disclosed in this petition as to why petitioner waited for 10 long years, Versus Counsel for Petitioner(s) : Pawan Kumar Yadav Counsel for Respondent(s) : A.S.G.I., C.S.C. There is nothing on record to demonstrate that petitioner in between 2015 to 2025 ever made any representation. In the circumstances, we direct the learned Standing Counsel to obtain instructions in the matter regarding claim of the petitioner. List on 06.11.2025.
