This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 13/2024 registered at Police Station Singhoda, District – Mahasamund (C.G.), for the offences punishable under Section 20(B) of the NDPS Act. 2. The prosecution story in brief, is that on the secret ANKIT KUMAR SINGH Digitally signed by ANKIT KUMAR SINGH Date: 2025.04.26 17:37:26 +0530 2 3. information through the informant, the raid was conducted by the Police authority and in that raid 100 Kgs of Ganja has been seized from the possession of the present applicant. Thereafter, the applicant was arrested and the case was registered by the Police. 4. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is further submitted that the charge-sheet has been filed in this case. The applicant is in jail since 09.09.2024. The conclusionof the trial is likely to take some time, therefore, he prays for grant of bail. 5. On the other hand, the learned counsel for the State opposes the bail application and submits that a total of 100 Kgs of Ganja has been seized from the possession of the applicant, which is much above the commercial quantity. She also submits that bail of the co-accused namely Sudhir Joshi has been rejected by order of this Court dated 17.02.2025 in MCRC No.1330 of 2025. It is further submitted that the charge-sheet has been filed in this case. Hence, this bail application is liable to be rejected. 6. I have heard learned counsel for the parties and perused thematerial available on record. 7. Taking into consideration the fact that the quantity of 3 contraband article seized from the possession of the applicant i.e. 100 Kgs of Ganja, is much above the commercial quantity and the applicant is failed to give any explanation for the same and it could not be a case of false implication, the charge-sheet has been filed in this case and even the bail of the co-accused namely Sudhir Joshi has already been rejected by order of this Court dated 17.02.2025 in MCRC No.1330 of 2025. Hence, the bail application of applicant – Lakhan Singh Lodhi involved in Crime No.13/2024, registered at Police Station – Singhoda, District – Mahasamund (C.G.) for the offence punishable under Section 20(B) of the NDPS Act, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
