HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 35359 of 2025 Court No. - 6 HON'BLE DR. YOGENDRA KUMAR SRIVASTAVA, J. Heard Sri Kailash Pati Singh Yadav, learned counsel for the petitioners and Sri Anand Bhaskar Srivastava, learned Standing Counsel appearing for the State-respondents. Present petition has been filed seeking following reliefs:
"a) To issue a writ, order, or direction in the nature of mandamus directing the respondents not to demolish the rest part of the house belonging to petitioners situated in plot no.1. b) To issue a writ, order, or direction in the nature of mandamus directing the respondents to pay the compensation to the petitioners in lieu of demolition the house belonging to petitioners by the respondents and also restrain the respondents not to construct upon the part which was demolished by the respondents." The reliefs sought in the writ petition are apparently vague with no particulars of the land/property in question having been specified regarding which a restraint order is being sought. Upon a query, counsel for the petitioners has submitted that an application under Section 24 of the U P Revenue Code, 2006 filed by the petitioners in regard to certain land parcel, of which the petitioners claim to be owners, is pending. Counsel for the petitioners has, however, not been able to explain as to how pendency of the said case would give the petitioners cause of action to seek the reliefs as have been prayed.
