JUSTICE ROBIN PHUKAN ORDER 06.08.2025 Heard Mr. B Dutta, learned Senior Counsel assisted by Mr. J. Das, learned counsel for the petitioner and Mr. A. K. Gupta, learned counsel for the respondent No. 2. Mr. Dutta, learned Senior Counsel made a statement before the Court, that during the pendency of this petition, final decree has already been drawn up by the learned Civil Judge (Sr. Div.), Tinsukia, and as such, this petition becomes infructuous and hence, he prays for according him permission to withdraw this petition, with a liberty to raise the grievance before the learned Civil Judge (Sr. Div.), Tinsukia, in respect of the final decree. Taking note of the submissions made by the learned counsels for both the parties, Mr. Dutta is allowed to withdraw this petition. However, liberty will remain with the petitioner to raise his grievance before the learned Civil Judge (Sr. Div.), Tinsukia, if it is permissible under the law.
