Mr. H. Tarunkumar, learned senior counsel, appears for the applicant. The present application has been filed by the applicant, praying as follows:
“Pass an appropriate order or direction granting leave to remove/shift/take out the EVMs and VVPATs under 1-inner Manipur Parliamentary Constituency used in the 18th Lok Sabha Election from the designated strong rooms.” The allegation of the election petitioners in the connected election petition is with regard to the nomination of the respondent (elected candidate), therefore, the Joint Chief Electoral Officer has filed the instant application seeking the aforesaid prayer. Mr. Ajoy Pebam, learned counsel appearing for the election petitioners and Mr. N. Ibotombi, learned senior counsel, appearing for the elected candidate, have no objection in allowing the present application. Since the respondents do not have any serious objection to the prayer sought for in the application and considering the averment made in the affidavit, this Court cannot have any legal impediment in allowing the present application, subject to rules. With the above observation, the present miscellaneous application is allowed.
