Order 12/06/2025
[2025:RJ-JP:23129] (2 of 3) [CRLMB-5180/2025] These bail applications have been filed by the accused- petitioners under Section 483 of B.N.S.S. in respect of FIR No.329/2024 registered with Police Station Tijara, District Bhiwadi for the offence under Sections 147, 148, 149, 323, 341 and 307 of IPC.
Learned counsel for the accused-petitioners would submit that the allegation of opening fire has been levelled against them whereas no person has received any fire arm injury. Injury sustained by any other injured has also not been opined to be dangerous to life. He further submits that co-accused Rajpal has been enlarged on bail vide order dated 27.03.2025 passed in S.B. Criminal Misc. Bail Application No.4155/2025 whereas, other co- accused persons namely Mahesh, Maharam, Sheeshram, Netram, Samay Singh and Aman Kumar have already been enlarged on bail by the Co-ordinate Bench of this Court.
Learned counsel for the accused-petitioners would also submit that the case of the petitioners are exactly similar to the co-accused who have already been released on bail. They are no longer required for custodial interrogation. Trial of the case is likely to take considerably long time. Learned Public Prosecutor has vehemently opposed the bail applications. Considered the submissions made at Bar. Taking into consideration the overall facts and circumstances of the case, this Court without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the accused-petitioners on bail.
