HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 36270 of 2025 Court No. - 6 HON'BLE DR. YOGENDRA KUMAR SRIVASTAVA, J. Heard Sri Dwijendra Prasad, learned counsel for the petitioners, Sri Nand Lal Maurya, learned Standing Counsel appearing for the State respondents and Sri Avinash Chandra Srivastava, learned counsel representing the respondent Gram Sabha. The present petition has been filed seeking to assail an order dated 19.09.2025, passed by the respondent no.2, the Additional Commissioner (Administration), Agra Division, Agra, whereby the stay application dated 19.7.2025 filed by the petitioner in Revision No. 2627 of 2025 (Computerized Case No. C202501000002627), [Sher Singh and Others Vs. Land Management Committee and Others], arising out of proceedings under Section 128 of the U.P. Revenue Code, 2006, has been rejected. In terms of the order impugned the delay in filing the revision has been condoned and notices have been directed to be issued to the contesting respondents. The order further records that the counsel for the revisionists could not place any material on the basis of which the stay could have been granted and for the said reason the stay application was rejected. Counsel for the petitioners has not been able to demonstrate any error or illegality in the order rejecting the stay application so as to warrant interference. The challenge to the order impugned passed by the revisional court rejecting the stay application is therefore not sustained. Versus Counsel for Petitioner(s) : Dwijendra Prasad, Pradyumna Kumar Counsel for Respondent(s) : Avinash Chandra Srivastava, C.S.C. Sher Singh And 4 Other .....Petitioner(s) State Of U.P. And 3 Other .....Respondent(s)
Counsel for the petitioners, at this stage, submits that he does not wish to press the petition and that the petitioners would submit a fresh application for interim relief before the revisional court, accompanied by a proper affidavit, for seeking an appropriate order. In the event any such application is filed by the petitioners, within a period of two weeks from date, the revisional court would be expected to accord due consideration to the same and make an endeavour to pass an appropriate order thereon, expeditiously, provided there is no legal impediment. The petition is disposed of. October 17, 2025 Arun K. Singh WRIC No. 36270 of 2025 2 (Dr. Yogendra Kumar Srivastava,J.) Digitally signed by :- ARUN KUMAR SINGH High Court of Judicature at Allahabad
