HIGH COURT OF JUDICATURE AT ALLAHABAD CONTEMPT APPLICATION (CIVIL) No. - 5941 of 2025 Court No. - 37 HON'BLE DINESH PATHAK, J. 1. Instant contempt application has been filed alleging wilful disobedience of the order dated 22.08.2024 passed by this Court in Public Interest Litigation (PIL) No.1590 of 2024. Relevant last paragraph of the order dated 22.08.2024 is quoted herein below :- "Considering the aforesaid facts and circumstances of the case, the Public Interest Litigation is being disposed of with a direction to the petitioner to move an application under Section 26 of the U.P. Revenue Code, 2006 within a period of two weeks from today before the respondent concerned. In the eventuality of filing such an application, the Revenue Authorities shall proceed to register a case and make all endeavour to conclude the proceedings within a period of two months, strictly, in accordance with law." 2. While confronted with the learned counsel for the applicant, he states that no specific application has been moved to initiate proceedings under Section 26 of the U.P. Revenue Code, 2006 within the stipulated period, as directed by this Court. He has laid emphasis on the registered representation dated 13.09.2024 moved by the present application (Annexure-2). 3. In my considered opinion, the present applicant ought to have filed a proper application under Section 26 of the U.P. Revenue Code, 2006 to remove the obstacles from the public pathway. However, appropriate application has not been filed, in compliance of the order dated 22.08.2024 passed by this Court. 4. I do not find any merit in the instant contempt application. As such, same is dismissed in limine. October 17, 2025 VR Versus Counsel for Applicant(s) : Indrakesh Kumar Sharma Counsel for Opposite Party(s) : (Dinesh Pathak,J.) Santram .....Applicant(s) Smt.
