Heard Sri Sanjeev Kumar Yadav, learned counsel for the petitioner, Sri Abhishek Shukla, learned Additional Chief Standing Counsel appearing for the State respondents and Sri Sudhir Bharti, learned counsel for respondent-Gram Sabha. The present petition has been filed to raise a challenge to the order dated 28.06.2025 passed by the Respondent No.2, the Additional Commissioner (Judicial) III, Gorakhpur in appeal no. C202505000001685 of 2025 (Yogendra vs. Smt. Lakshmi Devi and another), in terms of which the case was adjourned for the reason that the advocates were abstaining from work, and a further date has been fixed. Counsel for the petitioner, after making submissions to some extent states that he does not wish to press the relief as prayed, and makes a prayer for an alternative relief by seeking a direction to respondent no.2 to expedite the hearing for the appeal. A further indulgence is sought for a direction for early disposal of an application which is stated to have been filed for interim relief in the appeal. Attention of the Court has been drawn to the order sheet to indicate that number of dates have been fixed but the matter has been adjournment and the delay in disposal of the aforesaid matter is causing undue hardship to the petitioner. Having regard to the aforesaid, the present petition is disposed of with an observation that the court/authority concerned would make an endeavor to conclude the proceedings of the aforesaid appeal expeditiously, preferably within a period of six months, and the application for interim relief, within one month; from the date of production of a certified copy of this order, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
