1. Heard Mr. Arvind Shrivastava, learned counsel for the appellant as well as Mr.S.S.Baghel, learned Deputy Government Advocate appearing for the respondents/State. 2. The appellant has filed this writ appeal against the order dated 03.12.2024 passed by learned Single Judge in WPS No.7352 of 2024 by which the learned Single Judge has dismissed the writ petition filed by the appellant. 3. This Court by order dated 29.01.2025 passed the following order:-
“Put up the matter tomorrow to enable learned counsel for the State to inform this Court about the representation which was preferred by the petitioner/appellant for his transfer from Bijapur to Durg which was recommended by the S.P. concerned on 30-01-2024 and 22-08-2024 stated to be pending before the Director General of Police. The State counsel shall inform what decision has been taken by the Director General of Police, Raipur on the the representation of the appellant/petitioner. List this case on 30-01-2025.”

Learned Deputy Government Advocate appearing for the respondents/State submits that the representation sent by the petitioner/appellant for his transfer from Bijapur to Durg which was forwarded by the Superintendent of Police concerned on 30-01-2024 and 22-08-2024 stated to be pending before the Director General of Police and it is stated that because of the Model Code of Conduct, the same cannot be decided and the
3 same would be decided by the authority concerned as soon as the Model Code of Conduct comes to an end. 5.
5. In view of submissions made by learned State Counsel, the present writ appeal stands disposed of. No cost(s). 6. It is made clear that we have not interfered with the order passed by the learned Single Judge and it is hereby affirmed. The petitioner is under obligation to join his duties at Bijapur without awaiting for the decision on the representation by the respondent authority.
