Heard learned counsel for the petitioner, learned Standing Counsel for the respondent Nos. 1 to 8, Sri Kumar Dhananjay, learned counsel for the respondent Nos. 10, 13 and 14 and perused the records. 2. By means of present petition, petitioner has prayed for following relief: "i). Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent No. 2 to 8 to hand over the residential land property, Khata No. 336, Khasra No. 594, situated at Village Faridnagar, Pargana Jalalabad, Tehsil Modinagar, District Ghaziabad of the petitioner to the respondent No. 9 to 14 on 24.05.2025 without any court order or any written order. On the basis of petitioner sale deed dated 12.01.2011 and petitioner family's, residence on this residential land property, the petitioner should be given back possession by the respondent No. 9 to 14 and the petitioner should be given possession by the respondent No. 2 to 8 in accordance with law." 3. In our considered view, the relief is in the nature of injunction arising out of a pure civil dispute which may involve disputed questions of fact and hence, petitioner may avail remedy of civil suit, if so advised. According, we decline to grant indulgence in the matter. 4. Subject to aforesaid liberty, this petition is consigned to records.
