Heard Sri Muktesh Kumar Singh, learned counsel for the petitioner and the learned Standing Counsel for the State respondents. 2. The present petition has been filed seeking a direction to the respondent no. 3, the Sub Divisional Magistrate, Tehsil Machhalishahar, District Jaunpur, to decide the application of the petitioner for grant of fair price shop Licence No. SJG100 of Village Thaloi, Post Bhikharipur Kala, Block Sujanganj, Tehsil Machhalishahar, District Jaunpur to her being the dependent of her husband Shyam Lal. 3. It has been informed by the learned Standing Counsel that the application of the petitioner can be considered under Clause 5 of the Government Order dated 5.8.2019. 4. It is submitted by the counsel for the petitioner that the petitioner has already filed an application before the respondent no. 3 on 28.8.2025 after the death of her husband on 16.8.2025, which is within time in view of the aforesaid government order. 5. In the facts of the case, the present petition is disposed of with a direction upon the respondent no. 3 to accord consideration to the petitioner's application dated 28.8.2025, by passing an appropriate order, in accordance with law, within a period of one month, form the date of presentation of a certified copy of this order before him. 6. It is, however, clarified that this Court has not expressed any opinion on Versus Counsel for Petitioner(s) : Muktesh Kumar Singh Counsel for Respondent(s) : C.S.C. Smt. Amarawati .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) merits of the case and all issues are left open to be considered by the authority competent, at the first instance.
