JUSTICE A. GUNESHWAR SHARMA O R D E R 09-09-2025 [1] Heard Md. Fakharuddin, learned counsel for the petitioner and Mr. H. Debendra, learned Dy. Advocate General assisted by Ms. I. Sharmila Rahaman, learned counsel for the State respondents. [2] The petitioner, who is recorded pattadar for the land under Old Patta No. 422 corresponding to New Patta No. 39/876 covered by C.S. Dag No. XVIII/252/335 of Village No. 87(A)-Khwai Bazar, IWT, approached this Court, aggrieved by the notice dated 29-08-2025 issued by the Sub- Divisional Officer, Lamphel, Imphal West directing encroachers from Government land Dag No. 253 to vacate and directing encroachers to remove the unauthorized buildings from Dag No. 253 which is recorded in the name of the State. It is stated that no notice was given before issuing impugned eviction notice dated 29-08-2025. [3] On the other hand, Mr. H. Debendra, learned Dy. Advocate General for the State respondents, submits that notice was given to all the NINGOM BAM VICTORIA Digitally signed by NINGOMBAM VICTORIA Date: 2025.09.09 17:23:49 +05'30' WP(C) No. 711 of 2025 & MC(WP(C)) No. 667 of 2025 affected persons and by the impugned notice dated 29-08-2025, the authority gave direction to the encroachers to remove their structures from the Government land and the land of the petitioner under Dag No. 252 is not affected. [4] Md. Fakharuddin, learned counsel for the petitioner, submits that the Revenue authorities have marked in red colour upon the property of the petitioner erected in her patta land and she may be given an opportunity of being heard before actual eviction and demolition, if any, are to be carried out by the State authorities. [5] This Court is of the considered view that the writ petition may be disposed of at this stage by directing that there will be no eviction of the petitioner and her structure erected within Dag No. 252. However, any encroachment upon the Government land may be removed by giving opportunity of being heard to the affected persons. [6] With this observation, the writ petition is disposed. [7] MC(WP(C)) No. 667 of 2025 is also closed. [8] Furnish a copy of this order to the learned counsel appearing for the parties in the course of the day by Whatsapp. JUDGE Victoria
