HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 14889 of 2025 Court No. - 34 HON'BLE VIKAS BUDHWAR, J.
1. Sri Astitva Srivastava, learned counsel for the writ petitioner submits that the writ petitioner was inducted on 08.08.2019 as Computer Operator in MNREGA scheme, however, his services were dispensed with on 23.02.2025, which constrained the writ petitioner to approach this Court while filing Writ-A no.5323 of 2025, Nishant Agarwal vs. State of U.P. in which this Court on 17.07.2025, proceeded to stay the effect and the operation of the termination order and the writ petitioner was permitted to discharge duties as Computer Operator under MNREGA scheme. According to the writ petitioner, in compliance of the said order, on 10.08.2025, the Deputy Commissioner (Labour and Employment), MNREGA Cell, Rampur proceeded to reinstate the writ petitioner subject to outcome of the said writ petition, however, the designation which was assigned to the writ petitioner was 'Computer Operator' (Daily Wager). Learned counsel for the writ petitioner submits that there has been a virtual contempt of the interim order, as post obtaining of interim protection, the writ petitioner was entitled to the same status, which he was enjoying at the time of passing of the impugned order.
2. Sri Pramod Kumar Srivastava, learned Addl. Chief Standing Counsel on the other hand submits that once the writ petition, wherein interim order has been passed is pending and there is an allegation of willful disobedience of interim order, then the remedy lies elsewhere.
3. The said submission could not be disputed by learned counsel for the writ petitioner.
4. Considering the submissions so made across the Bar, the writ petition Versus Counsel for Petitioner(s) : Astitva Srivastava Counsel for Respondent(s) : C.S.C. Nishant Agarwal .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s)
stands disposed of leaving it open for the writ petitioner to take legal recourse, which is permissible once the order is not complied with and also to file application seeking amendment in the pending writ petition.
