------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH
----- For the Petitioner : Mr. Anurag Kashyap, Advocate For the State
: Mr. Rakesh Kumar Sinha, A.P.P. For the Informant : Mr. Rakesh Kumar Sinha, Advocate
--- 02/24.07.2025
Heard the parties.
The petitioner has been made accused in connection with Pandwa P.S. Case No.23 of 2025, for the offence under Sections 109, 118(2), 61(2), 333, 49, 3(5) of the B.N.S., 2023 and Sections 25(1-B) (a), 26, 27(1), 35 of the Arms Act, pending in the court of Sri Sambhu Mahto, learned Judicial Magistrate First Class, Palamau.
On 05.04.2025, when the informant was sitting in his house, two unknown persons came there and one of them fired at his wife causing firearm injuries. The assailant was apprehended at the spot who disclosed his name as Roshan Kumar. He also disclosed the name of co-accused as Raja Paswan who managed to flee from the place of occurrence.
Mr. Rakesh Kumar Sinha, learned counsel for the informant has vehemently opposed the prayer for bail and submitted that petitioner was having inimical terms with the informant and it is alleged that he had orchested the entire occurrence. Considering the fact that apart from suspicion there is no allegation against the petitioner on the record, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Sri Sambhu Mahto, learned Judicial Magistrate First Class, Palamau, in connection with Pandwa P.S. Case No.23 of 2025.
