Learned counsel for the applicant has submitted that the applicant has not committed any offence as alleged in the F.I.R. He has been falsely implicated in this case due to ulterior motive. No any police personnel has sustained any kind of injury. False recovery has been shown from the possession of the applicant by the police personnel. It is lastly submitted that co-accused Ramji Kushwaha has already been enlarged on bail by this Court vide order dated 7.10.2025 Versus Counsel for Applicant(s) : Rakesh Kumar Shukla Counsel for Opposite Party(s) : G.A. Vishal Yadav .....Applicant(s) State of U.P. .....Opposite Party(s)
passed in Criminal Misc. Bail Application No.32728 of 2025 and parity is sought in the matter. In case, the applicant is released on bail, he will not misuse the liberty of bail. 4. Per contra learned A.G.A. has opposed the prayer for bail of the applicant by contending that twenty motorcycles have been recovered from the possession of the applicant. In case the applicant is released on bail he will again indulge in similar activities and will misuse the liberty of bail. 5. Having considered the submissions of the parties noted above, finding force in the submissions made by the learned counsel for the applicant; keeping in view uncertainty regarding conclusion of trial; one sided investigation by police, ignoring the case of accused side; larger mandate of the Article 21 of the Constitution of India, bail application is allowed. 6. Considering the dictum of Apex Court in the case of Manish Sisodia Vs.
