HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 35029 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J. HON'BLE SWARUPAMA CHATURVEDI, J. 1. Heard Sri Sukesh Kumar, learned counsel for the petitioner and learned Standing Counsel for the State respondents. 2. By means of this petition filed under Article 226 of the Constitution of India, the petitioner prays for a direction to the District Magistrate to consider and dispose of the complaint made by the petitioner in his representation dated 17.06.2025 3. Upon a pointed query being made, learned counsel for the petitioner fairly admits that the real threat to life and property is from a family member namely his brother who is currently occupying the property in question and is also allegedly issuing threats to the petitioner's life. 4. In our considered view, as the grievance of the petitioner pertains to alleged criminal acts by his brother, the proper remedy available to him is by way of lodging a First Information Report (FIR) with the police and seek appropriate police protection. As far as the property dispute is concerned, the petitioner may avail remedy before the appropriate civil court forum, if so advised. 5. In the circumstances, while we decline to exercise our extraordinary jurisdiction at this stage, it is observed that, if the petitioner approaches the concerned police authorities for lodging Versus Counsel for Petitioner(s) : Rajesh Singh, Sukesh Kumar Counsel for Respondent(s) : C.S.C. Manish Kumar Keshari .....Petitioner(s) State Of U.P. And 5 Others .....Respondent(s) an FIR, the police shall act upon such complaint strictly in accordance with law and shall ensure that complaint made to it is investigated properly. 6. With above observation and directions this writ petition is disposed of. October 7, 2025 Gaurav WRIC No. 35029 of 2025 2 (Swarupama Chaturvedi,J.) (Ajit Kumar,J.)
