Heard Sri Shriprakash Shrivastava, learned counsel for the petitioner and learned Standing Counsel for the State. Mr. M.J. Akhtar, learned counsel has filed caveat on behalf of respondent no.4. 2. The instant petition has been filed for following reliefs:- "i) a suitable writ, order or directing in the nature of mandamus commanding and directing to the respondent no. 2 to decide the Case No.218/28.4.2023, Computer Case No.202354054465010067 (Sona Devi vs. Smt. Chandrawat Devi and Others) under Section 12 of the U.P.C.H. Act, 1953, filed on 28.04.2023 regarding mutation of the Gata No. 1672Ka area 24 dicimil out of 0.88 dicimil situated at Mauza Rampur Gonaha, Tappa Batesara, Tehsil Khadda, District Kushinagar; within stipulated period of time in that regard. ii) any other writ, order or direction as the Hon'ble Court may deem fit and proper in the facts and circumstances of the case. iii) Award cost of the writ petition to the petitioner." 3. Learned counsel for the petitioner submitted that proceeding under Section 12 of the U.P.C.H. Act is pending before respondent no. 2 Consolidation Officer (Antim Abhilekh), Kushi Nagar, Padrauna since Versus Counsel for Petitioner(s) : Shriprakash Shrivastava Counsel for Respondent(s) : C.S.C., M J Akhtar Sona Devi .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) 2023. He placed the certified copy of the order sheet of the pending proceeding in order to demonstrate that the matter is not proceeding expeditiously. 4. Considering the facts and circumstances of the case, the instant petition is finally disposed of directing the respondent no. 2- Consolidation Officer (Antim Abhilekh), Padrauna, District Kushi Nagar to decide the proceeding under Section 12 of the U.P.C.H. Act in accordance with law, after affording proper opportunity of hearing to the parties expeditiously, preferably within a period of four months from the date of production of a certified copy of this order.
