HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 23218 of 2025 Court No. - 47 HON'BLE RAJEEV MISRA, J.
HON'BLE DR. AJAY KUMAR-II, J.
1. Heard Mr. Prateek Srivastava, the learned counsel for petitioners and the learned A.G.A. representing State respondents 1 to 3.
2. Perused the record.
3. Present writ petition has been filed challenging the FIR dated 24.09.2025 registered as Case Crime No. 0976 of 2025, under Sections 115(2), 352, 351(2), 118(1) of BNS, 2023, 3(2)(va), 3(1)(da) and 3(1)gha of SC/ST Act, P.S.- Robertsganj, District- Sonbhadra.
4. At the very outset, learned A.G.A. has raised preliminary objection by contending that subsequent to the aforementioned F.I.R., injured has been examined. As per the medico legal report, injuries have been found on their person. It is thus contended by learned A.G.A. that in view of above, prima facie occurrence is proved. As such no interference is warranted in this writ petition.
5. When confronted with above, the learned counsel for petitioners fairly submits that present writ petition be dismissed as withdrawn with liberty to petitioners to apply for bail before competent court.
6. In view of the above, this writ petition is accordingly dismissed as withdrawn with liberty to petitioners to approach the competent court for grant of anticipatory bail/regular bail.
