Heard Sri Amit Kumar Srivastava, learned counsel for applicant, Sri Arvind Prabodh Dubey, learned counsel for opposite party no.2 and Sri Shatruhan Yadav, learned AGA for the State. 2. The instant transfer application has been filed by the applicant with a prayer to transfer the Case No. 22694 of 2024, under Section 138 N.I. Act, pending in the court of Additional Chief Judicial Magistrate-2, Jhansi to the court of Additional Chief Judicial Magistrate, Prayagraj. 3. Learned counsel for applicant submits, applicant is accused in complaint case filed by opposite party no.2 under Section 138 N.I. Act and he filed instant transfer application to transfer the proceedings of the case from District Jhansi to District Prayagraj on the ground that opposite party no.2 filed execution of the same case with regard to same amount in District Prayagraj vide Execution Petition No. 121 of 2022, therefore, for convenience of applicant and opposite party no.2 it is desirable to transfer the case from District Jhansi to District Prayagraj. 4. At this stage, learned counsel for opposite party no.2 submits, he is having no objection if trial of the case is transferred from District Jhansi to District Prayagraj. 5. Learned AGA also submitted that as opposite party no.2 is having no objection if trial of the case is transferred from Jhansi to District Prayagraj, therefore, he is also having no objection if transfer application is allowed. 6. I have heard both the parties and perused the record of the case. Versus Counsel for Applicant(s) : Amit Kumar Srivastava, Anukreeti Srivastava, Jitendra Singh Counsel for Opposite Party(s) : Arvind Prabodh Dubey, G.A. Man Singh .....Applicant(s) State of U.P. and Another .....Opposite Party(s) 7. Applicant is facing trial of complaint case under Section 138 N.I. Act which is pending in the District Court Jhansi and by way of instant transfer application he made a prayer to transfer the case from District Jhansi to Prayagraj on the ground that execution proceeding is pending in Prayagraj. 8. As, opposite party no.2 is having no objection if instant transfer application is allowed, therefore, the instant transfer application stands allowed. 9.
