In these circumstances, he may be permitted to withdraw this application with liberty to file a fresh application, keeping the right to challenge the recovery intact. 3. The prayer made by Learned counsel for the applicant is not objected by the Learned counsel for the opposite party No.2 4. In view of the above, the application is dismissed as withdrawn with the above-mentioned liberty.
