Order 16/09/2025 This appeal has been filed by the appellant challenging the
order dated 21.01.2019 passed by the learned Single Judge. The learned Single Judge while allowing the writ petition observed as under:-
“6. Thus, this Court is of the considered view that the matter requires to be remanded to the authority to re-examine the matter of the petitioner in relation to
[2025:RJ-JP:37686-DB] (2 of 2) [SAW-743/2019] proportionality of punishment vis a vis allegation levelled and also taking into
consideration the long services rendered by the petitioner. The respondents are expected to take a decision in this regard preferably within a period of two months from the date of submission of certified copy of this order and pass appropriate
order.
7. The orders impugned dated 17.5.2004 and 20.10.2004 are set aside with liberty to the respondents to pass fresh orders taking into consideration the services of petitioner within two months.
8. With the aforesaid observations, writ petition is allowed to the aforesaid extent.
9. No costs.” We have gone through the order passed by the learned Single Judge and we are in complete agreement with the view taken by the learned Single Judge. The learned Single Judge while allowing the writ petition has only remanded the matter back to the respondents for passing of fresh orders. Admittedly, till date, the respondents have not complied with the order passed by the learned Single Judge. In that view of the matter, this appeal stands dismissed.
