Respondent S Manjunath Babu is present. It is submitted that the petitioner who is the accused is in judicial custody. A compromise petition is filed under Section 147 of N.I. Act r/w Section 320 of Cr.P.C. As per the terms of compromise it is stated that towards full and final settlement a sum of Rs.3,50,000/- is paid by the petitioner to the respondent and respondent has admitted to receive the same. The respondent admitted that he has settled the matter for a sum of Rs.3,50,000/- and he has already received the amount. In the light of the settlement entered between the parties, the Criminal Revision Petition is allowed. The impugned judgment and order dated 04.12.2024 in Crl.A.No.104/2023 on the file of Prl.District and Sessions Judge - 3 - NC: 2025:KHC:9309 CRL.RP No. 322 of 2025 at Kolar and judgment and order dated 02.09.2023 in CC.No.1561/2022 on the file of Prl.Civil Judge and JMFC, at Srinivaspura are set aside. The respondent /accused is acquitted. Registry is directed to send a copy of this order to the Trial Court through email. In view of disposal of petition, pending applications stands disposed off, as no separate order is required.
