A case has been reg'lStered against the Petitioner and Others for the offences under section 111(2) of B.N.S.Act and Sections 20(b)(i-I)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act. 3. Case of the prosecution, iS that, On 18.9.2024 atabout 07.00 am, on receipt of credible information regarding illegal possession and transportat-Ion of ganja, the s.I of Police, along with staff and mediators rushed to R & B tar road junction, Sabbavaram and conducted vehicle checking. They found an auto bearing regiStrat-Ion nO.AP 31 TQ 1511 and a motorcycle bearing registration no.AP 39 LX 6760 com-lng towards them. on seeing police, the inmates of the auto and the rider and pillion rider of the motorcycle stopped their vehicles and tried to escape. Then police apprehended three persons while the rema-lning persons fled away. On enquiry, said three persons disclosed their identity particulars as that of Al to A3 and on search, police found 30 kgs of ganja in their possession. They confessed the involvement of petitioner/A7 in transportation of the ganja. police seized the contraband, arrested the accused and got remanded to judicial custody. police arrested the petitioner On 25.4.2025. 4. Heard learned counsel forthe petitioner and learned Assistant Public prosecutor for the respondent-State. Perused the record. 5. Learned Assistant Public Prosecutor submits that major portion Of investigation is completed, except filing of charge sheet, as the report from RFSL concerned is awaiting. Hence, prays to dismiss the Criminal Petition. \~|__ \'`.2S Ei-=- iE\`` +. --\\ 3 6. A perusal of materi.al available on record goes to show that the Petitioner Was arrested and remanded to judicial custody on 25.4.2025. Police, on credible information, seized 30 kgs of ganja from Al to A3. Pursuant to the confessional statement of co-accused, nothing has been seized from the possession of the petitioner to connect him with the crime. Pr,-ma fac,-e basing on the confessional statement of co-accused, the petitioner has been arrested and remanded to judicial custody. 7. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/A7 herein, on the following conditions. (i) The petitioner/A7 herein shall be released on his executing a Personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge-Gum-Special Judge for trial of Offences under NDPS Act, 1985, Visakhapatnam; (ii) On release, the petitioner shall appear before the station House Officer concerned once in a week i.e. on every sunday between 10.00 a.m. and 05.00 p.m., till filing of charge sheet. 8.
