JUSTICE PRANJAL DAS ORDER Date : 17.09.2025 1. Heard Mr. A. K. Bhuyan, learned Senior Counsel assisted by Mr. A. Khound, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State of Assam. 2. The petitioner, Jumi Das is seeking regular bail in connection with CID P. S. Case No.1/2016, under Sections 120B/420/468/471/409/406 of the IPC. Page No.# 2/3 The petitioner has been in pre-trial detention since 24.07.2025. 3. Interestingly, the FIR dated 01.01.2016 lodged by Senior Official of Canara Bank, Ulubari Branch in Guwahati with several allegations. 4. The gist of which is fraudulent transactions done by the accused persons causing losses to the customers of the Bank, including those having fixed deposits. 5. The present accused is one of the named accused in the FIR along with 4 others. 6. Learned Senior Counsel for the petitioner submits that after her arrest, the present accused was custodially examined; that no other criminal case is pending against her. It is also fairly submitted that pursuant to disciplinary proceedings she has also lost her service in the Bank. 7. The Case Diary has been received and learned Additional Public Prosecutor submits on the basis of the said Case Diary that there are sufficient implicating materials against the present petitioner and the investigation materials have found showing her complicity in the alleged offences. 8. It is also submitted that large volume of documents have already been seized in connection with the case. 9. On a query from the Court it is submitted that the statutory period with regard to Section 409 IPC is 90 days, while in regard to the other penal provisions, the same is 60 days. As already stated above, the case was registered in 2016 itself and though there seems to be significant progress in investigation, the same is not yet complete. 10. It is also pointed out that another co-accused has already been granted anticipatory bail. 11. Nevertheless, despite the incriminating materials revealed against the Page No.# 3/3 accused, considering the progress of investigation; registration of the case in 2016 itself, her custodial examination during investigation and no further prayer for custodial examination – I am inclined to allow bail to the accused at this stage. 12. Accordingly, petitioner, Jumi Das shall be allowed to go on bail bond of Rs.50,000/- with one suitable surety of like amount to the satisfaction of the learned concerned Court. 13. The direction for bail is further subject to the condition(s) that the accused petitioner; i. Shall co-operate with the investigation; ii. Shall not hamper or tamper with evidence; and iii. Shall not try to influence any witnesses. iv. As the accused is stated to be in a rented accommodation, in the event of her change in residential address, the same shall be informed to the learned Trial Court. 14. Violation or breach of condition(s) shall entail cancellation of the bail. 15. This bail application stands disposed of. 16. Send back the Case Diary. JUDGE Comparing Assistant
