ORAL JUDGMENT
(PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA) Learned Single Judge by the order dated 22.02.2023 while disposing of the writ petition observed and directed as under,
"Consequently, this writ petition stands disposed of with a specific direction to the Deputy Commissioner, Bangalore Urban District to consider the case of the petitioners for grant of dwelling houses and issuance of Hakkupatras in terms of their representations, as expeditiously as possible and at any rate within a period of three months from the date of receipt of copy of this
order."
2. In response to the non-compliance alleged of the aforesaid directions, the respondents appeared through learned Additional Government Advocate inter alia filing the compliance affidavit along with which produced was the copy of report of the Revenue Inspector dated 11.09.2024.
3. In that report, it is stated that certain documents were not received from the complainants-petitioners although the case of the

petitioners was considered in light of the directions of learned Single Judge.
4. Learned Additional Government Advocate submitted that only four members/beneficiaries submitted their documents. Be that as it may.
5. It is true that the direction of learned Single Judge is only to consider the case of the petitioners and the report of the Revenue Inspector aforementioned could be said to be amounting to
consideration of the case of the petitioners which would justify the closure of the present contempt proceedings. At the same time, the stand of the respondents is only technical and does not subserve the substantial justice. 5.1 As far as the contempt jurisdiction of the court under the Contempt of Courts Act, 1971 is concerned, it is not liable to be exercised in the facts of the case, however, while dropping the contempt proceedings, it is directed that the petitioners shall be at liberty to approach the competent authority-respondents with necessary documents within three weeks from today.

6. Once the documents are submitted and necessary application is filed, the respondents shall consider the case of the petitioners in that light and render a decision in accordance with law within further period of eight weeks.
7. The present petition is accordingly dismissed without going into the merits of the case of the either side.
