1.
Heard the Parties.
2.
The petitioner is alleging violation of order dated 05.01.2024 passed in WP(S) No.5659 of 2022.
3.
The learned counsel for the opposite parties submits that the aforesaid order was passed solely relying upon order dated 15.12.2023 passed in WP(S) No.4561 of 2016 (Vinod Kumar Pandey & Ors. Vs. State of Jharkhand & Ors.). He submits that in LPA No.180 of 2024, the final order passed in WP(S) No.4561 of 2016 has been set aside, thus the basis of the order passed in WP(S) No.5659 of 2022 does not remain.
4.
The fact that the order passed in WP(S) No.4561 of
2025:JHHC:30231 2
2016, has been set aside is also admitted by the petitioner.
5.
Considering the aforesaid fact, in my opinion it cannot be said that there is a willful and deliberate violation of the order dated 05.01.2024 passed in WP(S) No.5659 of 2022, thus this contempt petition is dropped.
