Verma, Additional Advocates General and Mr. Ravi Chauhan, Deputy Advocate General, for State. __________________________________________________________ Sandeep Sharma, Judge (oral): Petitioner herein, who at present is working as Staff Nurse at Pt. Jawahar Lal Nehru Government Medical College & Hospital, Chamba, District Chamba, Himachal Pradesh, has approached this Court in the instant proceedings seeking directions to respondents to consider and decide her representation (Annexure P-1), whereby she has prayed for her transfer from afore station to one of the station, as detailed in the representation, on the ground of adverse family circumstances.

Having regard to the nature of prayer and order proposed to be passed, this Court sees no sees no necessity to call for reply on behalf of respondents, who are otherwise represented by Mr. Rajan Kahol, learned Additional Advocate General. Mr. Kahol fairly states that representation, if not already decided, shall be decided expeditiously, in accordance with law. 1Whether the reporters of the local papers may be allowed to see the judgment?

Consequently, in view of the above, this Court, without going into the merits of the case, deems it fit to dispose of the present petition, with the direction to respondents to consider and decide the pending representation of the petitioner, expeditiously, preferably, within a period of two weeks, taking note of the fact that petitioner has already completed normal tenure of posting at present place of posting and on account of adverse family circumstances, it may not be possible for petitioner to continue at the present place of posting. Ordered accordingly. Needless to say, authority concerned while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass appropriate
order.

Having taken note of the fact that petitioner has been working at the present place of posting for more than six years, this Court hopes and trusts that authority concerned while considering the case of the petitioner, in terms of instant judgment, would not be influenced by the notification dated 26.06.2025, issued by the Government of Himachal Pradesh, whereby it has been mentioned that no Staff Nurse shall be relieved from the place of posting, in the interest of patient care.
