Heard learned counsel for the applicant and Sri Shashank Shekhar Pandey, learned A.G.A. for the State-opposite party. 2. The present bail application has been filed with the prayer to enlarge the applicant on bail in Case Crime No. 13 of 2025, under Section 105 B.N.S., Police Station Saifai, District Etawah during the pendency of the trial. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the instant case. The applicant is in jail since 01.02.2025 having no criminal history. 4. Learned AGA has opposed the prayer for bail. 5. Having heard learned counsel for the parties and after perusal of the record, the Court prima facie finds that specific role of assaulting the deceased Virendra on the head with a brick has been attributed to the applicant. As per the post-mortem report, two ante mortem injuries were found on the head of the deceased. In the opinion of the doctor, the cause of death is due to 'Cranio-cerebral injuries and its complications due to blunt force impact'. 6. The prosecution version stands corroborated by the post-mortem report and the statements of the eye witnesses. 7. Accordingly, the bail application is rejected. 8. It is made clear that the observations made in this order shall have no Versus Counsel for Applicant(s) : Satya Narayan Yadav Counsel for Opposite Party(s) : G.A. Sintu .....Applicant(s) State of U.P. .....Opposite Party(s) bearing on the merits of the case. 9. However, it is observed that the trial court would endeavour to conclude the trial expeditiously.
