HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 22445 of 2025 Court No. - 44 HON'BLE J.J. MUNIR, J.
HON'BLE SANJIV KUMAR, J. Heard Mr. Gaurang Dwivedi, learned counsel for the petitioners in support of this writ petition at substantial length, Mr. Deepak Mishra, learned A.G.A. for the State-respondents and Mr. Santosh Kumar Shukla, learned counsel appearing on behalf of respondent no.7. This petition has been filed seeking to quash the FIR dated 24.07.2021 giving rise to Case Crime No.288 of 2021, under Sections 302, 201 and 506 I.P.C., now converted under Section 306 I.P.C., Police Station Khekra, District Baghpat. The FIR was registered for offences punishable under Sections 302, 201 and 506 I.P.C. after the deceased Richhpal went missing. He was last seen in the company of the petitioners. No doubt, the case is one of circumstantial evidence but a perusal of the postmortem report, relating to the deceased, which is placed at page no.62 of the paper book, shows that the cause of death was opined by the autopsy doctor to be strangulation or hanging. A piece of cloth was found around the deceased's neck. Nevertheless, the doctor found the hyoid bone fractured from which an inference of strangulation is invariably drawn. The Police, for some reason, have found it to be a case of suicidal death and not homicidal and are investigating the matter as such. Whatever be the outcome of investigation, we are of considered opinion that in the circumstances that obtain in this case, it is not at all a matter, Versus Counsel for Petitioner(s) : Gaurang Dwivedi, Vineet Sankalp Counsel for Respondent(s) : G.A., Santosh Kumar Shukla Ajay Pal And 2 Others .....Petitioner(s) State Of U.P. And 6 Others .....Respondent(s)
where we should interfere with the on-going investigation in the exercise of our jurisdiction under Article 226 of the Constitution of India. This petition is dismissed.
