Shri Abhishek Tiwari, learned counsel assisted by Ms. Bhavana Mishra, learned counsel for the petitioner and Shri Mahendra Pandey, learned counsel holding brief of Shri Bhuvnesh Kumar Singh, learned counsel for the respondent no. 3 jointly submit that the matter arises out of a petty neighbourhood dispute. The parties have arrived at an amicable resolution of the dispute and the compromise between the parties has been reduced to writing. Learned counsel for both the parties contend that the parties do not wish to prosecute the criminal case in view of the aforesaid compromise. The aforesaid compromise between the parties has been duly verified by the Judicial Magistrate, Baghpat and the parties were identified before the learned Judicial Magistrate at the stage of verification of compromise. In wake of the aforesaid submissions no useful purpose will be served by permitting the criminal proceedings to be on foot. The F.I.R. dated 07.10.2023 under Section 323, 504, 506, 325, 452 IPC, Police Station Versus Counsel for Petitioner(s) : Abhishek Tiwari Counsel for Respondent(s) : Bhuvnesh Kumar Singh, G.A. Zahid And 3 Others .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) Baghpat, District Baghpat is liable to be quashed and is quashed. The writ petition is allowed.
