1. Mr. Gaurav Singh, learned counsel for the applicant.
2. Mr. Sandeep Sharma, learned Brief Holder for the State.
3. Present applicant-Sakir Ali is seeking regular bail in relation to FIR No. 07 of 2025 dated 04.01.2025, registered at P.S. SIDCUL whereby he has been implicated for the offence punishable under Section 8/22 of the NDPS Act.

As per the prosecution case, at the time of search three boxes containing 10 large leaflets in each boxes and 50 tablets in each leaflet a total of 1500 tablets in all three boxes, Tramadol hydrochloride tablets 100 mg on each box and 10 tablets on each leaflet, Celdical 100 SR Tablets were shown to be recovered from the possession of the applicant.

Learned counsel for the applicant submits that as per the prosecution the recovered contraband is below the commercial quantity, and, furthermore there is no compliance of mandatory provision of Sections 42, 50, 52A and 57 of the Act. Apart from this, the learned counsel for the applicant submits that the applicant has no previous criminal history.
6. On the other side, learned State counsel submits that the offence as committed by the applicant is serious, though, he has not disputed that the alleged contraband which was recovered from the possession of the applicant is
below the commercial quantity and applicant has no criminal history.

Having heard learned counsel for the parties, and taking into consideration that the applicant has no criminal history and contraband which was shown to be recovered from the possession of the applicant is below the commercial quantity, this Court is of the view that the applicant deserves for bail.
8. Accordingly, without expressing any opinion of the merits of the case, the bail application is allowed.
9. Let the applicant Sakir Ali be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
10. The bail application is disposed of finally.
