2025:JHHC:19164 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 3726 of 2025 ----- Aasif Khan, S/o Shamim Khan @ Saim Khan, R/o Masjid Gali Village Kute, P.O. Sandi, P.S. Sikidiri, District- Ranchi .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Nilesh Kumar, Advocate For the State : Mr. Fahad Allam, AddI. P.P. …...... 02/ 15.07.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. This is an application filed by the petitioner praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, apprehending his arrest for offences under Sections 379 of IPC. 3. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired on the confessional statement of the co-accused. He further submits that there is only one recovery of motorcycle, for which, he has already been taken in custody in Sadar P.S. Case No.94 of 2024, which is related to the present motorcycle and so far as another motorcycle is concerned, petitioner is not related. 4. The learned APP opposes the prayer for anticipatory bail and submits that other co-accused has confessed and submitted that it is the petitioner, who is constant companion of other co-accused in committing the offence. 5. After hearing the parties, I find that this case is theft of motorcycle. Admittedly, there are two cases pending against this petitioner, of similar nature. Thus, I find that this is not a fit case for grant of anticipatory bail to the petitioner. 6. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Sadar P.S. Case No.93 of 2024, pending in the Court of learned Judicial magistrate, First Class, Ranchi, stands rejected. 7. Petitioner should appear before the concerned Court. If the petitioner appears before the Court concerned, his case will be considered on its own merit. (ANANDA SEN, J.) R.S./
