Act, Police Station Chauri Chaura, District Gorakhpur, pending in the court of Chief Judicial Magistrate, Gorakhpur to the competent court of jurisdiction at Deoria. None for the applicant. The subject trial is pending since 2012 and the complainant herself lodged the first information report at district Gorakhpur, who is seeking transfer of the said trial to Deoria, as another case filed by her under Section 125 Code of Criminal Procedure is pending adjudication. The distance between the two towns is approximately 50 Kms. and as the case is based on police report, this Court does not find any ground to transfer the case, as the interest of the applicant is protected by the State.
