The petitioner has preferred instant writ petition challenging an order dated 08.09.2025 passed by respondent no. 4 pursuant to resolution dated 06.09.2025 passed by Board of Directors, placing the petitioner under suspension and for a further prayer to direct the respondents not to interfere in the functioning of the petitioner and pay him regular salary. Learned counsel for the petitioner submits that the petitioner was a peon in Kisan Sewa Sahkari Samiti Ltd., Chaudhera, Block Pahasu, District Bulandshahr. Earlier he was terminated by order dated 18.05.2023 which was challenged by means of Writ-A No. 10601 of 2023 and the said writ petition was allowed setting aside the termination order. In order to harass the petitioner, for reasons best known to respondent nos. 3 & 4, now the petitioner has been placed under suspension on the vague charges. In the suspension order, it is mentioned that the notice will be given within 15 days giving an opportunity to the petitioner to submit his reply. Neither any notice has been given to the petitioner nor he has been informed about the allegations on which he has been placed under suspension, thus, the aforesaid suspension order is arbitrary and illegal in the eyes of law. Learned counsel for respondent nos. 3 & 4 could not dispute the aforesaid fact. Having considered the submissions advanced by learned counsel for the parties and perusal of record, the petitioner has made out a case in favour of the petitioner. The order impugned dated 08.09.2025 set aside leaving Versus Counsel for Petitioner(s) : Sujeet Kumar Rai Counsel for Respondent(s) : C.S.C., Mahesh Narayan Mishra Dinesh Chand Sharma .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) it open to the authority to pass a fresh order in case required. The writ petition stands allowed accordingly. No order as to costs.
