ORDER The petitioner is before this Court against the impugned order passed by the respondents, wherein, the punishment imposed earlier with stoppage of increment for one year without cumulative effect was modified to blackmark was dismissed by the first respondent vide order dated 19.09.2007. The petitioner is a Grade I Police Constable and was found absent on 04.11.2002. Therefore, a Charge Memo was issued to the petitioner on 11.11.2002 which culminated in a punishment order dated 24.12.2002 from the respondent. On further appeal before the second respondent, the punishment was modified to blackmark against which the petitioner filed a Revision petition before the first respondent which has culminated in the impugned order dated 19.09.2007 in G.O.(2D)No.613 Home (Pol.V) Department. The petitioner was aged about 44 years when the writ petition was filed. At this time, the petitioner would have retired from service on attaining the 2/5 https://www.mhc.tn.gov.in/judis
W.P.No.22144 of 2010 age of superannuation. The punishment that was awarded was already been reduced to blackmark. As such, there are no grounds to interfere with the impugned order rejecting the Revision filed by the petitioner before the first respondent.
2. Therefore, this Writ Petition is dismissed. No costs.
