Heard Sri Ramesh Chandra Dwivedi, learned counsel for the petitioner and Sri Suresh Chandra Dwivedi, learned counsel for the respondents. 2. It appears that `petitioner was not diligent to pursue her case before Deputy Director of Education (Secondary) U.P., Lucknow, therefore, her claim was rejected with a specific observation that petitioner has failed to appear on the date fixed in the notice. 3. Learned counsel for the petitioner has denied the above referred averment and submitted hat petitioner is ready to appear as and when directed by this Court since the impugned order is passed under Section 16-E 10 of U.P. Intermediate Education Act, 1921 and her appointment was found contrary to the aforesaid provisions and an ex-parte order has caused her great prejudice, though said provision is not applicable in the present case. 4. Learned counsel for the respondents submitted that since the petitioner has failed to respond to the notice, therefore, there is no illegality in the impugned order and that above provision is applicable. 5. I have considered the above submissions and perused the records. 6. Though the petitioner appears to be not bonafide, still in the interest of justice, a last opportunity is given to her to appear before the authority concerned on 29.10.2025 during working hours and record her statement or produce documents, if any, and for that petitioner has to deposit Versus Counsel for Petitioner(s) : Ramesh Chandra Dwivedi Counsel for Respondent(s) : C.S.C., Suresh Chandra Dwivedi Smt. Sadhna Srivastava .....Petitioner(s) State Of U.P. And 5 Others .....Respondent(s) Rs.10,000/- before the High Court Bar Association, Allahabad within one week and thereafter concerned respondent will revisit the impugned order and while considering legal submissions if any, will take note of applicability or non-applicabilty of Section 16-E 10 of U.P.
