The petitioner has been made accused in connection with Mahabuang P.S. Case No. 09 of 2023, S.T. Case No.17 of 2024, for the offence under Section 376 of the Indian Penal Code, subsequently charges framed under Sections 376, 323 and 506 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge-I, Simdega. Bail application of the petitioner was earlier rejected by this Court vide B.A. No. 5933/2024, by order dated 30.08.2024. On 20.11.2023 at about 10:00 A.M., petitioner entered in the house of prosecutrix and raped her. It was submitted that four witnesses have been examined in this case. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail is hereby rejected. Learned Trial Court shall expedite the trial.
