The petitioners challenges the impugned FIR dated 12.08.2025 giving rise to Case Crime No.265 of 2025, under Sections 191(2), 190, 191(3), 333, 64(1), 74, 109(1), 352, 351(3), 324(4) BNS, 2023, Police Station Hathras Junction, District Hathras. The case of the petitioners is that it is the petitioners, who were assaulted but their FIR was not registered. It was registered much later on 16.08.2025 relating to same incident dated 11.08.2025. It is true that the impugned FIR, which has been lodged on 12.08.2025 also relates to the incident dated 11.08.2025. Assuming that this fact is true, there is definitely an incident that has happened, where there is a cross version and both sides have sustained injuries. In such circumstances, there is no good ground to quash the impugned FIR. The petitioners would have liberty to apply for bail and/or anticipatory bail, as advised. Subject to the above remarks, no case for quashing the impugned FIR is made out. This writ petition is dismissed.
