Heard Sri Prashant Mishra, learned counsel for the petitioner and Sri Anand Bhaskar Srivastava, learned Standing Counsel appearing for the State-respondents. The present petition has been filed seeking to assail the order dated 29.07.2025 passed by the respondent no.3 in Case No. 2069 of 2022, Gram Sabha vs. Devi Sharan & others (computerized case no. T202211520302069), whereby in proceedings under Section 25 of the U.P. Revenue Code, 2006, an order has been passed with a direction to invoke proceedings under Section 67 of the U.P. Revenue Code, 2006 in regard to alleged encroachments. It is submitted that pursuant to the aforesaid order proceedings under Section 67 of the U.P. Revenue Code, 2006 have been initiated. The legal right to initiate proceedings under Section 67 of the U.P. Revenue Code, 2006 in case of encroachments over Gram Sabha Land, is statutorily provided. In the event, proceedings under Section 67 have been initiated against the petitioner, it is always open to the petitioner to file his objections and contest the proceedings. The writ petition, at this stage, would not be entertainable for the reliefs which have been sought. The petition is disposed of leaving it open to the petitioner to avail the Versus Counsel for Petitioner(s) : Pradhumn Kumar Pandey, Prashant Mishra Counsel for Respondent(s) : C.S.C.
