1. In terms of the order dated 19th December, 2025 a report is furnished by the Medical Board of All India Institute of
2 Medical Sciences (AIIMS) Kalyani dated 30th December, 2025, said report along with two other documents dated 30th December, 2025 and 29th December, 2025 are taken on record. 2. Concerned authority of AIIMS Kalyani vide office order dated 29th December, 2025 constituted a Medical Board of three members which examined the petitioner on 30th December, 2025 and a report was prepared on 30th December, 2025. From such report dated 30th December, 2025 it appears that it is a case of nevus depigmentosus. As per medical report such clinical entity is a nevoid condition which is usually present since birth/early childhood and is not heritable and non progressive. It was also opined as it is nevus (Birth Mark) there is no contraindication for employment of the petitioner in the applied post. 3. Learned advocate representing Union of India has drawn attention of this Court to Clause XIIB(8) of Revised Guidelines for Review Medical Examination in Central Armed Police Forces and Assam Rifles dated May, 2021. According to the respondents nevus is one of the grounds to declare a candidate medically unfit. 4. However, for better understanding of the issue Court finds it fit to quote Clause XIIB(8) below:-

“8. Congenital or acquired anomalies of the skin such as nevi or vascular tumors that interfere with function, or are exposed to constant irritation are disqualifying. History of Dysplastic Nevus Syndrome is disqualifying.”
5. It appears as per aforesaid clause skin problem such as nevi or vascular tumors that interfere with function or exposed to constant irritation are disqualifying. It is also provided in the aforesaid clause that history of dysplastic nevus syndrome is disqualified. 6. Taking note of the medical report dated 30th December, 2025 it does not appear that Medical Board opined petitioner is diagnosed with such skin condition (nevi) that interferes with function or is exposed to constant irritation. Skin issue of the petitioner is also not termed as dysplastic nevus syndrome rather it is opined in medical report dated 30th December, 2025 that nevus depigmentosus as it is found while examining the petitioner is not heritable and non progressive.
Therefore, it was concluded in the said report that there is no contraindication for employment of the petitioner in the applied post. 7. In aforesaid conspectus Court directs concerned respondent authority to appoint the petitioner as Constable (GD) by 8 (eight) weeks from the date of communication of this order, if petitioner is found otherwise eligible. 4
8. With the aforesaid directions writ petition stands disposed of. 9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (SAUGATA BHATTACHARYYA, J.)
