Zubeir Mr. Rizwan Ahmed Khan For Respondent(s) : Mr. Rajendra Singh Shekhawat, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 19/05/2025 1. The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.0066/2024 registered at Police Station-Special Police Station (SOG), District-ATS and SOG for the offences under Sections 420, 467, 468, 471 and 120B of IPC, [2025:RJ-JP:21016] (2 of 3) [CRLMB-6313/2025] Sections 3, 4, 6 and 10 of the Rajasthan Public Examination (Prevention of Unfair Means) Act, 2022. 2. Since both the bail applications arise out of common FIR, therefore these cases are being decided by a single order. 3. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. He further submits that the petitioner- Suresh Chandra never participated in any examination nor provided mobile/sim to anybody. The only allegation against him is that his photo has been used on Aadhar Card to which a sim has been procured by the co-accused in this case and the allegation against the petitioner-Mukesh Lora is that he has used the bluetooth device in the examination. He further submits that the similarly situated co-accused-Sunil Jakhar, Ram Singh, Om Prakash, Ms. Nirma Manda, Anil Saran, Sunil Dhayal, Praveen Kumar, Rajaram and Deepak Prajapat, who participated as a candidate in this case have already been enlarged on bail by the Co-ordinate Bench of this Court on 24.01.2025. Charge-sheet has been filed. The petitioner-Suresh Chandra is behind the Bar since his date of arrest and Mukesh Lora is behind the Bar since 23.04.2025. The trial of the case may take considerable time. Hence, on the ground of parity, the bail applications of the petitioners may be allowed. 5. Learned Public Prosecutor has vehemently opposed the bail [2025:RJ-JP:21016] (3 of 3) [CRLMB-6313/2025] applications. 6. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, on the ground of parity but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 7. Accordingly, the bail applications under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners- (1) Suresh Chandra S/o Shri Baburam (2) Mukesh Lora S/o Shri Dungaram shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
