HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 34801 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J.
HON'BLE SWARUPAMA CHATURVEDI, J.
1. Heard Sri Syed Mushfiq Ali, learned counsel for the petitioner and Sri Jai Krishna Narain Sharma, learned counsel appearing for the respondents-Union of India. 2. Petitioner is aggrieved by the cancellation of his tender application vide e-cancellation inrespect of allotment of parking area. 3. It is argued on behalf of petitioner that no opportunity of hearing was afforded to the petitioner before resorting to e-cancellation of bid application of petitioner. 4. Per contra, it is argued by learned counsel appearing for Union of India that as per the requirement vide Notice Inviting Tender on e-portal of the Authority, a person applying for a bid was required to have a turnover of Rs. 20 lakhs and above in three financial years, whereas petitioner had shown only one financial year 2024-25 a turnover of more than Rs. 20 lakhs and failed to annex details of previous two financial years' turnover. Still further upon verification that the authority found that the petitioner's turnover for the financial year 2024-2025 was only Rs. 16,36,180/-. Thus, according to him as per the policy Circular no. 11 of 2022 of respondents vide its clause no. 1.2 the tender bid application of the petitioner was liable to be cancelled. 5. We have perused the documents brought on record and find merit in the submission advanced on behalf of respondents. Even upon repeated query Versus Counsel for Petitioner(s) : Syed Mushfiq Ali Counsel for Respondent(s) : A.S.G.I., Jai Krishna Narain Sharma M/S Rudra Constructions .....Petitioner(s) Union Of India And 2 Others .....Respondent(s)
being made, learned counsel for the petitioner could not demonstrate that while applying pursuant to the Notice Inviting Tender application he had placed documents showing a turnover of more than Rs. 20 lakhs in the previous financial year 2023-24, nor could he dispute the detailed verification report brought on record by way of instructions which is based upon verification of facts through Unique Document Identification Number of the petitioner. 6. Beside the above, we find from the records filed by the petitioner himself vide Annexure-3 to the writ petition, that while he submitted
"View Modified Turnover Details", he failed to give details of turnover of previous financial years 2023-2024 and 2022-2023. 7.
In view of the above therefore, the respondents are found to be justified in taking recourse to e-cancellation of the tender application of the petitioner invoking provisions contained under clause 1.2 of the Circular No. 11 of 2022. Thus we find writ petition to be devoid of merits and is accordingly, dismissed. October 7, 2025 Kirti WRIC No. 34801 of 2025 2 (Swarupama Chaturvedi,J.) (Ajit Kumar,J.)
