HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 32510 of 2025 Court No. - 68 HON'BLE ASHUTOSH SRIVASTAVA, J. Heard learned counsel for the applicant, Shri Yogendra Pal Singh, learned counsel for the first informant and Shri Manoj Kumar Singh, learned A.G.A. for the State. This bail application under Section 483 B.N.S.S. has been moved on behalf of accused-applicant, Ravikant, seeking enlargement on bail in Case Crime No. 302 of 2025, under Sections 191 (2), 191 (3), 190, 109, 110, 351 (2), 3(5) B.N.S. and Section 3/25/27 of Arms Act, Police Station-Mavana, District Meerut.
Learned counsel for the applicant argued that the accused-applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 08.08.2025. First Information Report has been lodged on 24.07.2025, by the first informant, with the allegation that the son of the first informant namely Kuldeep, along with his friends namely Ritik and Mukul, went for cutting hair on the shop of one Parvej. All the named accused persons and some other persons came on four bikes and started indiscriminate firing in which the son of the first informant namely Kuldeep sustained gun shot injury below the hip and over head whereas, his friend Ritik has received injury over his head.
Learned counsel for the applicant submits that only general role has been assigned to all the accused persons in the First Information Report. No specific role has been assigned to the applicant. First Informant in his statement has assigned the role of giving blow by iron rod over the head of the Ritik and there is contradiction in the First Information Report and statement of the first informant. Learned counsel for the applicant further submits that the injured Ritik has also not named the applicant in his statement. Criminal history of one case has been explained in paragraph no. 15 of the affidavit filed in support of bail application and there is no likelihood of his fleeing from course of justice or tampering with evidence in case of release on bail. Hence, bail has been prayed for.
