The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed to quash the entire proceedings of Criminal Case No. 10407 of 2025, arising out of Case Crime No. 392 of 2025, under Sections 109, 191(2), 191(3), 190, 351(2), 117(2) of B.N.S., Police Station- Majhola, District- Moradabad as well as cognizance/summoning order dated 13.8.2025, pending in the Court of Chief Judicial Magistrate, Moradabad. After some arguments, learned counsel for the applicants does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. The instant application is dismissed as not pressed with liberty to file appropriate application/bail application/Anticipatory Bail Application/proceedings before the court of competent jurisdiction.
