1. Heard Mr. R. Ali, learned counsel appearing for the accused petitioner as well as Mr. D. P. Goswami, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the
Page No.# 2/3 accused-petitioner, namely, Alim Uddin, who is stated to have been arrested on 02.08.2025 praying for grant of bail in connection with Barama P.S. Case No.61/2025 under Sections 61(2)/140(2)/317(3) /310(5)/310(6)/111(2) (b)/111(3)/111(4) BNS. 3. The allegation in the FIR dated 16.07.2025 is dacoity of a truck bearing registration No. RJ09QE6232 carrying pan masala of Rs.80 lakhs. 4. Learned counsel for the petitioner submits that the present accused has been arrested solely on suspicion and he has been in pre-trial detention after his arrest on 02.08.2025 and there has been no recovery from his possession and seeks that his bail prayer may be considered. 5. Mr. D. P. Goswami, learned Additional Public Prosecutor has produced the case diary and submits that there is sufficient implication material against petitioner vis-à-vis the CDR analysis done by the IO, which also tallies with some of the locations pursuant to the alleged offence. 6. It is further submitted that he is stated to be one of the main accused involved in the alleged offence and with regard to him several other cases are also pending. 7. I have perused the CDR analysis available in the case diary with regard to the accused person and I fine force in the contentions of the prosecution regarding the same. It is important to note that investigating officer has made a narration in the case diary that the accused person found to be involved in vehicle hacking offence in multiple cases with same modus operandi. It is further stated that even after getting bail in some other cases he is conducting to indulge in these activities. 8.
As stated above, I have seen the period of detention; however, we cannot overlook that the alleged offences are serious in nature and the investigation reveals serious implicating materials against the accused petitioner. Page No.# 3/3
